Understand your rights as a foreign student worker

If you are a student coming to America with a visa, then you have a high likelihood of getting in with no trouble. However, once you are here, there are many restrictions placed on you. There are certain things you can or cannot do.

One of the things you may want to do is to have a part-time job. Employers may hire students with visas, which is good news for you. You do need to know what an employer may or may not ask you, though. You want to make sure that you do not end up working for someone who is racist or screening you based on where you come from.

What can an employer ask an international student when hiring?

Employers may ask if you are legally authorized to work in the United States. If an employer hires someone who is not authorized, they could face serious fines and penalties. If you are not authorized to work, you could threaten your right to remain in the United States. Make sure that you have the right to work and that the employer is hiring you under the correct pretenses.

Employers may also ask which languages you can read, speak or write. Some jobs require full English language skills, while others may benefit from foreign language skills.

Employers are not able to ask about your place of birth, country of citizenship, nationality or visa type. they also may not ask your native language. These are preventative laws that keep employers from discriminating based on an immigrant's background information, which would be unfair.
