Plea deals: Understand their value in your case

A trial can have major implications for your future, and many people question if it's worth taking a plea to avoid it. While every case is different, there are some benefits to taking a plea deal.

What you need to understand about a plea deal, first of all, is that the prosecution and your defense attorney have to agree on the charges you'll be convicted of as well as the penalties. If they do and you do as well, then this is presented to the judge for approval.

Why is taking a plea better than trial?

It can be better than a trial if you have a case where the outcome is relatively uncertain. For instance, if you have a lot of evidence against you, taking a guilty plea for a lesser crime and avoiding a public trial may be your best chance of facing fewer penalties.

Trials are, by nature, unpredictable. While there may be a more likely outcome, there is no guarantee. The best thing about a plea deal is that it's normally guaranteed. The only risk to you would be if the judge refuses the plea for some reason. Then, your attorney and the prosecution can try for a different plea or go to trial instead.

The prosecution and courts want to see you agree to a plea because it saves time and money. It secures an outcome for at least some kind of penalties, which is something that you need to think about carefully. If you know you're innocent or don't think there's enough to convict you, then it may be in your better interest to head to court.
