U.S. Immigration Law and privilege to drive in Georgia

Georgia, like many other states, is home to thousands of people who have come across United States borders to escape abject poverty, violence and oppression in their native lands. Various aspects of U.S. Immigration Law are complicated, thus sometimes making the adjustment to living in a new place personally and legally challenging. There are certain topics that have repeatedly made the news in recent times, including whether undocumented immigrants should be allowed to apply for restricted driving privileges.

With regard to this topic, six immigrants in Georgia have reportedly taken legal action against the state. They claim that the state stands in violation of federal law and has denied their Constitutional rights by not allowing them to obtain legal permission to drive. These six people apparently have all been authorized to accept employment in the United States.

A class action lawsuit has been filed on behalf of the six immigrants. It is obviously very difficult to get to work if one is unable to drive. A spokesperson from the Department of Driver Services stated that there is a set code in place  that governs non-citizen driving issues.

One of the men involved in the class action suit has resided in the United States since approximately 1990, and he has three children who are American citizens. Often, state laws that attempt to govern immigrant relations are often superseded by U.S. Immigration Law. Apparently, thousands of people may be impacted by the outcome of the current lawsuit in Georgia. Anyone concerned with similar issues may seek legal advice by contacting an immigration and naturalization attorney.
