How is deportation affected by the recent executive action?

A recent series of executive orders has substantially changed certain aspects of the process of deportation from Georgia and around the country. These executive orders, announced by President Obama on Nov. 20, 2014, are expected to be substantially implemented by the affected agencies during the year 2015.

One program affected by the recent changes is Deferred Action for Childhood Arrivals. The upper age limit on the program has been lifted, and now anyone born prior to Jan. 15, 1981, may apply just like the other users of the program. Continuous residence in the United States is now only required since Jan. 1, 2010, instead of 2007 as it was previously. Applications for the DACA program under the new rules go into effect 90 days after the signing of the executive order.

An undocumented immigrant parent of an American citizen will now be able to petition the government for deferred action, so long as they meet all necessary qualifications for the program. They must have continually resided in America since Jan. 1, 2010, the child in question must have been born before the day that the order was signed and they must not be considered an enforcement priority for removal from the United States. Naturalization candidates will now also be allowed to pay the fees for their applications with credit cards.

Individuals seeking to make a change in their immigration status may find it advisable to consult with an immigration attorney for advice and guidance. The attorney can find the most appropriate methods for altering the status and work to expedite the process. Immigration laws often change quickly, and the advice of counsel can be valuable to those that are affected.
