Obtaining relief and protection from removal

Immigrants living in Georgia may benefit from understanding more about the relief and protections available to prevent removal. People involved in removal proceedings in Immigration Court or with the Board of Immigration Appeals may apply for benefits that might include withholding from removal, receiving asylum, removal cancellation, waivers of inadmissibility or an adjustment to permanent residency status. The authority presiding these matters is the Executive Office of Immigration Review, a division of the U.S. Department of Justice.

According to U.S. Citizenship and Immigration Services, people interested in being adjudicated from removal proceedings must follow the application instructions very closely. The stringent instructions are designed to ensure that applicants have completed the security and background checks that are required by the Department of Homeland Security before EOIR judges grant relief or protections from removal. After the removal proceeding is completed, applicants may receive instructions for obtaining documentation for the work authorization and updated immigration status.

The USCIS emphasizes the importance of following the pre and post-order instructions closely and on its website provides PDF copies of the pre-order instructions, post-order instructions, DHS procedures for the EOIR background check and a fact sheet covering the immigration benefits available in the removal proceedings. As described by the DHS, the procedures are designed to provide instructions in the three critical phases of completing the process, including filing the application with USCIS, appearing for biometrics and appearing for work and status authorization if relief is granted.
