Decatur issues policy limiting compliance with ICE detainers

Decatur recently took a huge step forward in protecting the rights and privileges of immigrants who may face deportation under the new immigration guidelines laid out by the Trump administration. The city manager signed off on a policy directed at Decatur law enforcement, instructing officers that they may not detain or arrest, or even transport any person if they would only do so because of a detaining order from U.S. Immigration and Customs Enforcement (ICE).

These detainers, issued by ICE, ask local jails to hold certain individuals for up to 48 hours so that ICE can acquire those individuals in order to deport them. According to the policy, law enforcement in Decatur is not allowed to comply with these detainers, which many legal authorities believe violate the constitutional rights of those who are held and handed over to the federal agency because of them.

This is not the first action of its kind in the area. Within the last several months, the Clarkston and Atlanta City Councils implemented similar policies limiting local law enforcement from complying with these detainers.

This is good news for immigrant communities in a very difficult time.
