The Child Citizenship Act of 2000 can make a difference to you

Your happiest moment was bringing your child into the world, but you certainly didn't expect to do so while out of the country. You know your child has a right to become a U.S. citizen, but do you have to exercise that right? What steps do you need to take to make sure your child is a citizen of your home country? You should speak with your attorney about the Child Citizenship Act of 2000.

What should you know about the Child Citizenship Act of 2000?

The Child Citizenship Act of 2000 is an act that makes it possible for children born in foreign places to obtain citizenship through their U.S citizen parent. The child obtains that citizenship automatically when he or she meets the required conditions while under the age of 18. For example, if you are a child born to American parents while visiting Germany, you would legally have the right to German citizenship but could also pursue citizenship in the United States through your parents.

What are the requirements of the Child Citizenship Act?

There are three requirements that have to be met. The first is that at least one parent has to be a United States citizen. The parent doesn't have to have been born in the United States; as long as he or she has been naturalized or is a citizen by birth, that meets the requirement.

Next, the child needs to be under 18. If both these conditions are met, then the only other thing that must be proven is that the child has lived in the United States or is currently living in the United States with his or her American parent for the purposes of lawful admission into the United States as a permanent resident.

If your child meets these conditions, becoming a citizen is relatively straightforward. Your attorney can help you fill out the correct documents to begin. Our website has more information.
