Court hears first immigration detention case of its kind

A situation has developed in a state outside Georgia involving an immigrant and her 9-year-old son. The pair is said to have fled their native land in fear of persecution. What happened once they entered the United States, however, has become the subject of a lawsuit filed against the U.S. government regarding immigration detention.

Reportedly, the case is the first of its kind. The mother and son are suing for alleged inappropriate detention and mistreatment. The claim states that the child and his mother were separated from their father/husband in 2015 when they fled to the United States. They sought help after the mother reportedly spoke out against Honduran police after the murders of two of her loved ones.

The woman said she was threatened and physically assaulted, and feared further persecution. According to a Yale Law School advocacy clinic, the federal government is obligated to protect those in its custody who have fled their homelands in fear of persecution. The woman and child in this case have stated that instead of being protected, they were detained under harsh conditions in a Texas detention facility.

Several immigration detention centers throughout the nation have been shut down in recent times due to unhygienic conditions and inappropriate treatment of detainees. Many adults and children have claimed to have suffered both physical and emotional injuries while under the supervision of various detention center officials.
