The Appeals Process

Depending on the case, we may first appeal to the hearing officer to review his or her ruling based on the legal arguments in our appeal. If the reconsideration is denied, the case is forwarded to the AAO or the BIA.

If you receive a notice of denial, we will prepare for the Board of Immigration Appeals. The appeal is considered by a single judge or sometimes a panel of three judges. Unlike a hearing or trial, BIA appeals are conducted through written briefs and supporting documents. We have also appealed unfavorable BIA decisions to federal court (11th U.S. Circuit Court of Appeals).
